Donald Trump Flack Says Email Reveals Who Took Passports From Mar
A Donald Trump spokesman is doubling down on the former president’s assertion that federal law enforcement seized his passports after an earlier report stated the Department of Justice said it did not have the sensitive documents.
Taylor Budowich, Trump’s director of communications, on Monday posted to an email apparently from a top DOJ national security official saying that the passports had been seized by “filter agents” and would be returned. The tweet, which targeted CBS News reporting, followed a series of contentious exchanges over the FBI‘s search of Trump’s Mar-a-Lago resort home in Florida.
Budowich’s tweet was in response to CBS News’ Norah O’Donnell tweeting that a DOJ official told the news outlet that “the FBI is NOT in possession of former President Trump’s passports.” The reporting contradicted a post Trump made earlier to his Truth Social network in which he said FBI agents had taken three of his passports, one of which had expired.
“We are also learning tonight that if any items not contained in the warrant were retrieved during the FBI search at Mar-a-Lago, they will be returned,” O’Donnell said in a followup tweet.
Budowich responded Monday with a redacted email from Jay Bratt, head of counterintelligence in the DOJ’s national security division, saying that he learned the passports, two expired, had been seized by “filter agents” and would be ready for pickup later that day.

Democratic lawmakers could use the 14th Amendment to keep former president Donald Trump from running for the presidency again in the 2024 election, according to an opinion piece.
Section 3 of the 14th Amendment states that a person is disqualified from being president, vice-president, senator or representative in Congress if they participated in an insurrection or rebellion or aided such acts against the United States while holding federal office.
To use the 14th Amendment, the Democratic Party could file a lawsuit against Trump in federal court, seeking a ruling that Trump participated in the Jan. 6, 2021, Capitol insurrection and an order that would disqualify him from running even as a candidate for the presidency. Trump can then choose to fight the lawsuit or claim the Fifth Amendment privilege against self-incrimination, according to an opinion piece written by Alan B. Morrison and published by The Hill.
Trump was impeached by the House of Representatives in January for a charge of incitement of insurrection after a mob of his supporters stormed the Capitol in the final days of his office. The riot led to the death of five people, including a Capitol police officer.

Soon after FBI agents raided his Mar-a-Lago estate, former President Donald Trump posted a statement decrying the weaponization of the justice system. He called the search political targeting at the highest level, and contrasted what was happening to him with what happened to his 2016 Democratic opponent.

Now, according to news accounts, the Justice Department is probing Trump and the classified documents he took with him to Mar-a-Lago after he left office. The Justice Department has not responded to questions about the search, so we dont know what if anything was removed from the property.

On Sunday, the former president called on the Department of Justice to return the seized documents, citing a Fox News report that at least five of the 27 boxes removed from Mar-a-Lago contained information covered by attorney-client or executive privilege.
Oh great! It has just been learned that the FBI, in its now famous raid of Mar-a-Lago, took boxes of privileged attorney-client material, and also executive privileged material, which they knowingly should not have taken, Trump said on his Truth Social site.

Vast quantities is, of course, a subjective term. But the quantities do differ somewhat in these two situations.
With Clinton, Comey said 113 emails were found to have contained classified information, including eight email chains that had information marked top secret at the time they were sent.
With Trump, we still dont know the full extent of what he took to Mar-a-Lago. But the partially redacted search warrant affidavit released last week said that Trump in January voluntarily returned 184 classified documents, including 25 that were marked top secret. The search earlier this month turned up 11 more sets of classified documents, including several that were top secret.
We dont have the final numbers the New York Times last week put the total number of classified documents at more than 300 but the government has retrieved more classified and top-secret documents from him than from Clinton.
From there, the question is whether the number of documents is considered vast and exposed enough to support an inference of intentional misconduct.

Indications Of Disloyalty To The United States
There is no evidence that Clinton sought to obscure the information out of disloyalty to her country. Even if you think Comey too readily accepted her explanation of convenience, the most readily available alternative explanation is that she didnt want these records to be obtainable because they could harm her political career. Thats not the same as disloyalty.
With Trump, the evidence on this front is very incomplete and disloyalty to the United States is a very high bar. We do know that there was urgency to retrieve the documents for some reason, but despite plenty of speculation, we dont know why that was.

The debate over what is to be done with Donald Trump and his alleged mishandling of sensitive government documents has landed in the zone where it was inevitably headed: whataboutism. Hillary Clinton escaped prosecution for using a private email server as secretary of state in 2016, the right argues, so why should Trump be indicted?
In this case, we use whataboutism non-judgmentally. Indeed, it might be fitting and instructive to compare the two situations, especially given that their central figures occupy similar positions in our national politics as de facto figureheads of their parties who had access to highly sensitive information. A core principle of our justice system, after all, is that the law be applied equally.
But that doesnt mean the two situations are the same or even particularly similar. Even as our understanding of why the FBI searched Trumps Mar-a-Lago estate earlier this month remains incomplete, some key differences have emerged.
And applying the Clinton standard might not augur as well for Trump as proponents seem to believe.
The Wall Street Journals editorial board, meanwhile, argued this weekend that if Attorney General Merrick Garland cant prove Trumps conduct was worse than Clintons, then the better judgment is not to prosecute and put the country through the trauma of a political trial that half of America will suspect is a case of unequal justice.

Less than four months after former President Donald J. Trump left office, the general counsel of the National Archives reached out to three lawyers who had worked with Mr. Trump to convey a firm message: The archives had determined that more than two dozen boxes of Mr. Trumps presidential records were missing, and it needed the lawyers immediate assistance to retrieve them, according to an email obtained by The New York Times.
The email, sent on May 6, 2021, by the top lawyer at the archives, Gary M. Stern, was an early sign of tension between Mr. Trump and the federal agency responsible for safeguarding presidential records. It presaged the battle that would later erupt over the former presidents removal of scores of highly sensitive documents from the White House.
On Tuesday, the archives released a separate letter, indicating that Mr. Trump had taken more than 700 pages of classified materials when he left Washington. Among them, the letter said, were some related to Special Access Programs, which are among the countrys most secretive intelligence operations.

A Key Difference Between The Two
Bradley Moss, a Washington-based lawyer who works on national security cases, said the cases of Clinton and Trump are significantly different.
Trump took properly marked hard copy classified documents from the White House, shipped them to Florida, and stored them in an unsecured location at his residence, Moss said.
The presence of classified information in Clintons emails was less obvious.
The e-mails were never marked as classified because these were communications from unclassified government accounts, Moss said.
In three instances, email chains included information with classification markers. It was never clear that Clinton was aware of the presence of that marked information, or if the classification marking was clear.
When classified information was clearly involved, Blanton said Clintons briefings were on a different system, a classified Blackberry that was managed by State Department IT people.
Clintons emails included moments when staffers wrote that for them to go into more detail, they would need to switch to a secure classified State Department system.
Moss cautioned that while some documents at Mar-a-Lago were clearly marked as classified, many questions remain, such as where the records were originally located, who boxed them up, when Trump became aware of the existence of the records at Mar-a-Lago, and what, if any, efforts Trump took to rectify the situation once he was informed.
