A Yes And Yes But Some Rules Apply

Regarding Dependency and Indemnity Compensation . a remarried surviving spouse whose subsequent marriage is annulled or declared void can reestablish eligibility as a surviving spouse. However, effective September 30, 1998, the law was changed to allow a surviving spouse to reestablish DIC eligibility after termination of remarriage. Therefore. after September 30, 1998, eligibility for DIC is established in any case in which the remarriage of the surviving spouse is terminated by death, divorce, or annulment. Also, remarriage of a surviving spouse after the age of 57 does not preclude continued payment of DIC.

Regarding Death Pension benefits, the law generally requires a surviving spouses entitlement to be terminated if the surviving spouse remarries, regardless of age, even if that remarriage is terminated by death or divorce. However, VA regulations establish limited exceptions that generally allow entitlement to Death Pension to be reestablished if the marriage was:

  • Annulled or declared void
  • Terminated by death or divorce on or after January 1, 1971, and before November 1, 1990.

Accordingly, you can again receive pension benefits based upon your former spouses wartime service if the new marriage was annulled or declared void or you fall within the divorce and death exception window, January 1, 1971 through October 31, 1990.

A Guide To The Va Aid And Attendance Benefit

When it comes to paying for senior living, many older adults remain unaware of the options available. This rings especially true for one payment source: the Department of Veterans Affairs Aid and Attendance program.

More than half of all veterans are 65 or older, according to the latest VA statistics. While the longstanding VA Aid and Attendance benefit can cover thousands each year in a veterans senior living and caregiving expenses, only an estimated quarter of eligible seniors apply.

Many people fail to apply because they assume theyre not eligible, says Suzette Graham, founder and CEO of Patriot Angels, a trusted partner of A Place for Mom.

In truth, eligibility may be less restrictive than you think. Countless veterans and survivors are unaware the VA Aid and Attendance benefit exists, but once they learn about the benefit, they say it sounds too good to be true.

Patriot Angels made it possible to provide my father with the care he needed. Without their assistance, we might still be waiting to hear word from the VA about whether or not my father qualified for a pension. They encouraged us and made us feel like we werent alone. I dont use these words often, but the work Patriot Angels did for us felt like an extension of Gods grace to us, like a tool in His hand. How very grateful we are.

What Types Of Senior Care Does The Va Aid And Attendance Benefit Cover

Older veterans or their surviving spouses who can no longer manage their care independently can use VA Aid and Attendance benefits to help cover the cost of assisted living, memory care, a nursing home, or in-home care services.

According to Graham, any senior living community can help a veteran or their surviving spouse so long as that community provides 24-hour staffing and the veteran requires assistance with at least two of the six activities of daily living allowed by the VA.

    Paying Family Members As Caregivers

    Veterans Aid and Attendance Benefits

Many readers are unaware that VA Pensions can be used to pay a family member who is the caregiver of a veteran or survivor . As mentioned previously, care expenses can be deducted from a Veteran or surviving spouses income, including payments made to family members, such as children or grandchildren. Beneficiaries can then receive an increased pension benefit equal to the amount they have paid to their family member for care.

Unfortunately, this method does not work for the veterans spouse since joint income is calculated as household income. Therefore, any salary the spouse received would be included as part of their household income, and would not be considered a deductible care expense.
