Polls Point To Clear Top Tier

Joe Biden was the accepted frontrunner in this race throughout 2019. After serving as Barack Obama’s vice-president for eight years, he had strong name recognition and held a clear lead in national polls.

His numbers dipped at the start of 2020 though and Bernie Sanders overtook him in the RealClearPolitics national average after a strong showing in the Iowa caucuses. Biden, however, won by a big margin in South Carolina, which helped boost his poll numbers before he then swept the South on Super Tuesday.

Boebert To Lake: How Many 2020 Election Deniers Won Their Races

At least 126 Republicans elected in the US midterms have publicly denied the result of the 2020 presidential election, according to a BBC analysis.

They include Marjorie Taylor Greene, the controversial politician whose personal Twitter account was suspended for breaking rules on coronavirus misinformation, and JD Vance, a former Trump critic and successful author.

Donald Trump continues to insist, falsely, that he won the 2020 election.

Before the midterms, we analysed and independently verified data published by the website FiveThirtyEight, which tracked statements from all candidates running for the Senate, House of Representatives and state governor positions. We found 178 of them – all Republicans – had fully and publicly denied the result of the presidential race supporting Trump’s false claim that he beat Joe Biden.

That accounted for more than one third of all Republicans standing in the races.

Our findings so far, one week after election day:

• At least 126 election deniers have won House, Senate and governor seats
• 48 have lost their races

There are four House races involving election deniers yet to be called: Alaska’s sole seat, where Sarah Palin is the Republican nominee, Lauren Boebert’s race in Colorado, and two districts in California.

Many candidates were nominated in solid Republican voting areas, so victory was more or less guaranteed, but some surprising election night stories have emerged.

Wood V Raffensperger No 20

Complaint Filed: November 13, 2020

State: Georgia

Current Status or Final Disposition: Motion to Expedite Denied Distributed for Conference Scheduled February 19, 2021

Summary: Plaintiff Wood, an individual Georgia voter, sued various George election officials to enjoin certification of the November general election results, secure a recount, and establish new rules for the January senate run-off election. Wood claimed that the absentee-ballot and recount procedures violated state law and his rights under the U.S. Constitution. The District Court for the Northern District of Georgia denied Woods motion for a temporary restraining order enjoining the certification of the state election results, and Wood appealed. The Eleventh Circuit affirmed, holding that because Georgia had already certified its election results, the motion to delay certification was moot. Following the Eleventh Circuit decision, the plaintiffs petitioned for writ of certiorari with the U.S. Supreme Court and filed an accompanying motion to expedite consideration. The Court denied the motion to expedite on January 11, 2021. But on January 27, the case was distributed for conference, scheduled for February 19.

Suburban Shifts In The Sun Belt

Suburban voting patterns also made a difference in the Sun Belt, especially in large southern states where suburbanization has been rampant. The focus here is on two such states: Georgia, where Biden is ahead and a recount has been announced and Texas, which Trump won, but where urban and suburban voting patterns closed the longtime Republican-Democratic gap. See Figure 3 and Downloadable Tables A and B.

A Democratic presidential candidate has not won Georgia since Bill Clinton took the state in 1992. Yet its demographic shiftsincluding brisk growth in the states Democratic-leaning Black population, gains in Latino or Hispanic and Asian Americans voters, and an increase in white college graduates, especially in the Atlanta metropolitan areaserved to make the state competitive for Democrats this year.

Georgias urban core counties helped the 2020 result swing toward Democrats. The counties of Fulton, DeKalb, and Clayton have consistently voted Democratic in recent elections. The populous counties of Gwinnett, Cobb, and Henry flipped to voting Democratic in 2016, and increased their Democratic margins even more so this year. Other suburban counties that showed increased Democratic support since 2016 were Douglas, Newton, and Rockdale.

Stoddard V City Election Commission Of Detroit No 20

Complaint Filed: November 4, 2020

State: Michigan

Current Status or Final Disposition: Motion for Injunctive Relief Denied

Summary: Individual voter Stoddard and the Election Integrity Fund filed suit against the City Election Commission of the City of Detroit, Chairperson of the City Election Commission Winfrey, and the Wayne County Board of Canvassers. The plaintiffs requested a preliminary injunction to: require the defendants to retain all original and duplicate ballots and poll books and enjoin certification of the county election results until party inspectors could compare the duplicate ballots with the originals. The plaintiffs claimed that an injunction was necessary because party inspectors were not present at each table inside the absentee vote counting board location. The Third Judicial Circuit Court for Wayne County disagreed with the plaintiffs, finding that the plain language of the relevant state statute only required that each major party have a representative present at the site of the absentee vote counting. The court also noted that the plaintiffs had failed to identify concrete occurrences of the alleged violations of state election law.

Current Status or Final Disposition: Fourth Circuit Granted Motion to Voluntarily Dismiss District Court Granted in Part and Denied in Part Intervenors Motion for Relief

Summary: Democracy North Carolina, the League of Women Voters of North Carolina, and individual voters sued the State Board of Elections over state laws that impose restrictions on in-person early voting availability, mail-in absentee voting, and voter registration. The plaintiffs alleged that North Carolinas 25-day registration waiting requirement burdens North Carolinians right to vote under 42 U.S.C. § 1983, the First and Fourteenth Amendments, and the Americans with Disabilities Act. They also sought a waiver of the states requirement that absentee voters notarize or have their ballot signed by two witnesses, and to relax the 25-day deadline for requesting absentee ballots. In particular, the plaintiffs wanted increased health and safety measures at the polls, with additional polling locations in light of the COVID-19 pandemic. On October 6, the Fourth Circuit granted the motion to voluntarily dismiss the case.

Jo Jorgensen Libertarian Party

Libertarian candidate Jo Jorgensen was the only minor candidate to breach a million votes nationwide, getting more than 1% of the national votes and more than the margin between the two major candidates, Donald Trump and Joe Biden, in several battleground states. She was also the only minor candidate who was on the ballot in every state.

Self Advocacy Solutions North Dakota V Jaeger No : 20

Complaint Filed: May 1, 2020

State: North Dakota

Current Status or Final Disposition: Permanent Injunction Granted

Summary: Self Advocacy Solutions North Dakota and other advocacy groups sued North Dakota Secretary of State Jaeger and the Grand Forks County auditor, challenging a state law that does not provide voters an opportunity to cure mismatched signatures on their ballots. The District Court for the District of North Dakota issued a preliminary injunction on June 3, finding that there was no potential for voter confusion as a result of enjoining the signature-matching process, which occurs after voters cast their ballots. As such, the court reasoned, the admonition that federal courts should refrain from changing election rules close to an election did not apply.

Trump Immunity Claim In 2020 Civil Rights Suit Rejected By Judge

— Donald Trump cant claim presidential immunity to avoid a lawsuit that accuses him of civil rights violations in his efforts to undermine the results of the 2020 election, a federal judge ruled Monday.

Trump had argued that he was absolutely immune from damages for actions within the outer perimeter of his official duties as president, and that his post-election activities in 2020 were part of an effort to protect and defend the Constitution.

But US District Judge Emmet Sullivan in Washington agreed with the challengers — the NAACP and Michigan voters and advocates — that Trumps conduct was purely political, according to the ruling.

If Former President Trump disrupted the certification of the electoral vote count, as Plaintiffs allege here, such actions would not constitute executive action in defense of the Constitution, Sullivan said. For these reasons, the Court concludes that Former President Trump is not immune from monetary damages.

The judge granted a motion by the plaintiffs to file an amended complaint against Trump and the Republican National Committee, but has yet to determine whether they are liable for civil rights violations.

Trump attorney Jesse Binnall and RNC lawyer David Warrington, who also is also representing Trump in his lawsuit challenging a subpoena from the Jan. 6 congressional committee, didnt immediately return requests for comment.

Robinson V Board Of Elections No : 20

Complaint Filed: May 21, 2020

State: District of Columbia

Current Status or Final Disposition: Case Dismissed with Prejudice

Summary: Individual voters filed suit against the D.C. Board of Elections alleging that the closure of the majority of polling places in Ward 8 violated the Voting Rights Act because the policy prevented members of a protected class from having equal opportunities to participate in elections. Ward 8 of D.C. is over 92% African-American. The District Court for D.C. denied the plaintiffs motion for a temporary restraining order in a telephonic hearing. The court dismissed after the parties settled the case.

The Five Republicans Who Could Challenge Trump In 2024

Former President Trump has hinted repeatedly that hes weighing another bid for the White House in 2024.

And while hes made clear that, if he does so, the nomination should be his for the taking, he could still face some competition. A number of Republicans have begun maneuvering toward presidential campaigns of their own, some more overtly than others.

Of course, theres a political risk that comes with challenging Trump. But that doesnt appear to be deterring some prospective candidates.

Here are the five Republicans who could challenge Trump for the partys 2024 presidential nod.

Ron DeSantis

Florida Gov. Ron DeSantis has brushed off suggestions that he will mount a presidential campaign in 2024, saying that his No. 1 priority is winning a second term in the governors mansion.

But he also hasnt explicitly ruled out the possibility, and unlike several other prospective GOP presidential contenders, he hasnt committed to forgoing a White House bid if Trump launches a comeback campaign.

And with his clout among Republicans on the rise, its possible that, if DeSantis ultimately decides to run in 2024, he may not be deterred by the former president.

Early polling shows him as the heavy favorite for the Republican presidential nomination if Trump doesnt run again. There are even a few recent surveys that show him topping Trump in a hypothetical primary match-up.

Biden entered the race with the kind of name recognition that made him a de facto front-runner. But hes also faced questions about accusations from women about unwanted touching, money, messaging, age, identity and ideology in a political environment vastly different from the one he began his career in decades ago.

Pressure On State And Local Officials

As the Trump campaign’s lawsuits were repeatedly rejected in court, Trump personally communicated with Republican local and state officials in at least three states, including state legislators, attorneys general, and governors who had supported him in the general election and continued to support him. He pressured them to overturn the election results in their states by recounting votes, throwing out certain votes, or getting the state legislature to replace the elected Democratic slate of Electoral College members with a Republican slate of electors chosen by the legislature. In late November, he personally phoned Republican members of two county electoral boards in Michigan, trying to get them to reverse their certification of the result in their county. He then invited members of the Michigan state legislature to the White House, where they declined his suggestion that they choose a new slate of electors. He repeatedly spoke to the Republican governor of Georgia and the secretary of state, demanding that they reverse their state’s election results, threatening them with political retaliation when they did not, strongly criticizing them in speeches and tweets, and demanding that the governor resign.

Notable Expenditures And Allegations Of Grifting

In June 2018, ProPublica reported that Trump Organization properties had received at least $16.1 millionfrom his campaign, Republican organizations, and government agencies since late 2015. In October 2019, OpenSecrets found that total spending on Trump properties had increased to $16.8 million even when just considering payments made by the Trump campaign and other Republican political campaigns and PACs .

During the first three months of 2017, the Trump 2020 campaign reported spending $6.3 million, of which nearly $500,000 was to companies owned by Trump. In the Trump 2020 campaigns first two years , it paid more than $890,000 in rent for space in Trump Tower, while the Republican National Committee paid $225,000. As of October 2020, the campaigns committees had directed more than $17.9 million of campaign donor money to Trump properties, while the Republican National Committee had paid $3.0 million.

As of March 2019, Trumps campaign had spent almost twice as much on Facebook and Google ads as the entire Democratic field combined.

Drenth V Boockvar No : 20

State: Pennsylvania

Current Status or Final Disposition: Defendants Motion for Summary Judgment Granted

Summary: The vice president of the National Federation of the Blind of Pennsylvania and the organization itself sued Secretary of the Commonwealth Boockvar, challenging the states refusal to give disabled voters the option to receive their mail-in ballots online, as allowed for members of the military. Plaintiffs alleged that the refusal to grant these accommodations to disabled voters violates the Americans with Disabilities Act. The U.S. District Court for the Middle District of Pennsylvania granted the defendants motion for summary judgment after the parties reached an agreement to implement a remote ballot marking system for the November 2020 Election.

Wisconsin Voters Alliance V Wisconsin Elections Commission No 2020ap001930

Complaint Filed: November 24, 2020

State: Wisconsin

Current Status or Final Disposition: Petition for Original Action Denied

Summary: Petitioners, the Wisconsin Voters Alliance and several individual electors, filed an emergency petition for original action in the Supreme Court of Wisconsin against respondents, the Wisconsin Elections Commission and its individual members. The petition claimed that state and local election officials in cities that had received funds from Facebook CEO Zuckerbergs Center for Technology and Civic Life organization, had used these funds to illegally circumvent Wisconsin absentee voting laws, primarily the law providing for an exception to the states photo identification requirement. As such, the petitioners sought to declare the election results in Wisconsin null. The Supreme Court of Wisconsin denied the petition for leave to commence an original action in a 4-3 vote, concluding that there were issues of material fact that rendered the case inappropriate for the court to exercise its original jurisdiction. In a concurring opinion, Justice Hagedorn stated that the petition falls far short of the kind of compelling evidence and legal support we would undoubtedly need to countenance the court-ordered disenfranchisement of every Wisconsin voter.

Sen Ted Cruz Of Texas

Cruz, 50, could start out a 2024 election campaign in a much stronger position than his first run in 2016, when he came in second. Its not uncommon for Republicans to select the recent runner up to later be their nominee which is what happened to Mitt Romney, John McCain, Bob Dole and Ronald Reagan.

A lot has happened to Cruz since 2016. For one, he became an ardent Trump supporter and grew a beard. But Cruz has also learned lessons from his first presidential run. Should he run again in the 2024 election, hed be a much more experienced campaigner with a more finely tuned message, higher name ID, and a carefully maintained donor base, one Republican strategist said.

Cruz has also faced backlash for objecting to President Joe Bidens Electoral College win. Following the deadly Jan. 6 attack on the Capitol, seven Democrats asked the Senate Ethics Committee to investigate Cruz and Sen. Josh Hawley, R-Mo., for amplifying claims of election fraud that led to violence. In Texas, the Republican Accountability Project paid for 100 billboards calling on Cruz to resign. Cruz also angered some close to him, like a longtime friend and former campaign chair who denounced him, and his chief spokesperson, who resigned, according to the Dallas Morning News.
