The Trump administration on Tuesday slammed the door on new applications for the program that allows the children of illegal immigrants to remain in the United States.

A memo from acting Homeland Security Secretary Chad Wolf said current enrollees in the Deferred Action for Childhood Arrivals program can renew their protection from deportation on an annual basis.

The memo came about a month after a Supreme Court ruling in which President Donald Trumps effort to end DACA was blocked. A majority of justices said no policy rationale was given for ending the program, which was created by former President Barack Obama through an executive order in 2012.

The decision, announced by the Department of Homeland Security in a statement on its website, was framed by Wolf as an interim step in response to the Supreme Courts decision.


As the Department continues looking at the policy and considers future action, the fact remains that Congress should act on this matter, Wolf said. There are important policy reasons that may warrant the full rescission of the DACA policy.

Renewals for DACA now will be on an annual basis rather than every two years.

In the full Department of Homeland Security memo, Wolf fired off a shot at Congress for failing to resolve the issue of illegal immigrants who came to the United States with their parents, often as young children.

What is DACA?

DACA, an acronym for Deferred Action for Childhood Arrivals, is a policy that protects around 800,000 young people known as DREAMers who entered the United States unlawfully as children. The program does not grant them official legal status or a pathway to citizenship, but it does allow them to apply for a drivers license, social security number, and work permit.


President Trump repeatedly tried to dismantle the program, established by President Barack Obama in 2012. A federal judge ruled in December, 2020 that first-time DACA applicants were permitted to apply, after the Trump administration stopped accepting new applications. He also extended the renewal period to two years, from one year.

IMPORTANT: In July 2021, a federal judge ruled that first-time DACA applicants were barred from applying to the program. USCIS has confirmed that all individuals whose DACA requests were approved prior to July 16, 2021 will continue to have DACA status and all DACA requests that were approved before July 16 will continue to be eligible to renew DACA and DACA work permits. The Department of Homeland Security will also continue to accept the filing of initial DACA and employment authorization requests, but they cannot approve initial DACA and EAD requests on account of judges ruling.

Several Democratic lawmakers applauded the decision by the court, proclaiming it a victory while also pushing for more permanent protections for Dreamers.

House Speaker Nancy Pelosi praised the decision in a press conference Thursday, saying it supports our values as a country.

Many lawmakers pointed to the Dream and Promise Act, a bill making its way through the Senate that prohibits removal proceedings against certain immigrants and provides them with a path to permanent resident status, as a next step in the fight for DACA.

Daca: Judge Orders Trump To Restore Undocumented Immigrants Scheme

A US judge has ordered the Trump administration to fully reinstate a scheme that protects immigrants brought to the country illegally as children from being deported.

The administration had moved to close the Deferred Action for Childhood Arrivals programme to new applicants earlier this year.

But District Judge Nicholas Garaufis on Friday ruled against the restrictions.

He told the administration to announce the full resumption of Daca by Monday.

The Daca programme was introduced by former Democratic President Barack Obama in 2012.


He set it up to help some of the more than 10 million immigrants who as young people entered the US illegally or overstayed a visa.

Most of the children protected by the Daca programme are from Mexico and other Latin American countries. These migrants are known as “Dreamers”.

The scheme protected an estimated 700,000 people, offering temporary permits for work and study.

But as part of his efforts to curb immigration, US President Donald Trump sought to end the programme in 2017, calling it unconstitutional.

The Supreme Court took up the case after lower courts ruled the administration did not adequately explain why it was ending the programme, criticising the White House’s “capricious” explanations.

In June this year, the Supreme Court upheld lower court rulings that found Mr Trump’s move to rescind Daca was “unlawful”.

The Supreme Court on Thursday blocked the Trump administrations attempt to end Deferred Action for Childhood Arrivals, an Obama-era program that protects hundreds of thousands of immigrants brought to the US as children from deportation.

The 5-4 ruling was written by Chief Justice John Roberts and joined by Justices Ruth Bader Ginsburg, Elena Kagan, Stephen Breyer and Sonia Sotomayor.

In penning the opinion, Roberts once again sided with the liberals on the bench in a momentous dispute that will infuriate judicial conservatives who are still bitter that he once provided the deciding vote to uphold Obamacare.


The opinion is the second time in a week when the Supreme Court bolstered with two of President Donald Trumps nominees has ruled against the Trump administration. Monday, the court said LGBTQ Americans are protected under the Civil Rights Act.

The ruling emphasizes that the administration failed to provide an adequate reason to justify ending the DACA program.

We do not decide whether DACA or its rescission are sound policies, Roberts wrote in the majority opinion. The wisdom of those decisions is none of our concern. We address only whether the agency complied with the procedural requirement that it provide a reasoned explanation for its action.

The joy of todays victory does not erase the difficult road ahead, Biden said in a statement. We know that much work remains to be done.

Trump Administration Actions On Daca

Trump administration rescinds DACA

At a press briefing on September 5, 2017, Attorney General Jeff Sessions announced that Acting Secretary of Homeland Security Elaine Duke had issued a memo rescinding DACA. The memo outlined an end to DACA taking place over several months. The initial end date of March 5, 2018, was delayed after federal judges in San Francisco and New York issued preliminary injunctions requiring the Trump administration to continue renewing DACA permits.

In his official statement, President Trump stated that benefits for some individuals could remain in effect for up to two years.

The memo described the reasoning behind the rescission of DACA as follows:

In his press briefing, Sessions said that the program was “an unconstitutional exercise of the executive branch” and that it was his duty to uphold constitutional order.

The Struggle To Save Daca Is Far From Over

The Biden administration could still seek to appeal the most recent court decision. While DHS announced it would comply with the court order and not approve new applications, it also stated that it would continue to implement the components of DACA that remain in place, and work on publishing a Notice of Proposed Rulemaking designed to strengthen and fortify DACA.

Violations Of The Administrative Procedure Act

In concluding that the DACA termination violated the APA, the Court reasoned, first, that the U.S. Department of Homeland Security failed to distinguish between the protections from deportation and the benefits that come with DACA. DHS did not consider whether to retain the protections from deportation even if the benefits were terminated. Second, DHS did not consider the hardship rescission would cause to DACA recipients and its farreaching consequences and the enormous reliance interests at stake. The Court specifically noted the respondents words:

Respondents and their amici assert that there was much for DHS to consider. They stress that, since 2012, DACA recipients have enrolled in degree programs, embarked on careers, started businesses, purchased homes, and even married and had children, all in reliance on the DACA program. The consequences of the rescission, respondents emphasize, would radiate outward to DACA recipients families, including their 200,000 U.S.-citizen children, to the schools where DACA recipients study and teach, and to the employers who have invested time and money in training them. Trump also said he has advised the Department of Homeland Security “that DACA recipients are not enforcement priorities unless they are criminals, are involved in criminal activity, or are members of a gang.”

Meanwhile, Sessions repeatedly referred to DACA as unconstitutional and criticized it as “unilateral executive amnesty.” He said it “yielded terrible humanitarian consequences” and had “denied jobs to hundreds of thousands of Americans by allowing those same jobs to go to illegal aliens.”

“We are a people of compassion and we are a people of law. But there is nothing compassionate about the failure to enforce immigration laws,” Sessions said.

“The compassionate thing is to end the lawlessness, enforce our laws, and, if Congress chooses to make changes to those laws, to do so through the process set forth by our Founders in a way that advances the interest of the nation,” he continued.

Lawsuits Against The Rescission Of Daca

New York v. Trump

Sixteen state attorneys general initiated legal action against the rescission of DACA on September 6, 2017:

The lawsuit argued that the memo rescinding DACA violated the Fifth Amendment because it “target individuals for discriminatory treatment based on their national origin, without lawful justification” and did not contain a prohibition against “the use of information contained in DACA applications and renewal requests for purposes of immigration enforcement.” The lawsuit also argued that the federal agencies responsible for the memo “acted arbitrarily and capriciously, and otherwise not in accordance with law, and have abused their discretion” in violation of the Administrative Procedures Act. The lawsuit asked the court to place a preliminary injunction on the memo, which would prevent DACA from being rescinded. The government moved to dismiss the lawsuit. The district court held arguments on the preliminary injunction and motion to dismiss on January 18, 2017.

On February 13, 2018, Judge Nicholas Garaufis issued a preliminary injunction temporarily blocking the Trump administration’s order ending the DACA program. The plaintiffs in the case filed suit to challenge that order. They argued in part that the Trump administration’s order violated the Administrative Procedure Act . They asked the court to issue a preliminary injunction to temporarily block the order while the case proceeded.

What Is Daca And Why Does Donald Trump Want To End It

President Donald Trump will announce Tuesday that he is ending a program that protects undocumented immigrants brought to this country as children from being deported.

Nearly 800,000 undocumented immigrants are under the umbrella of the program the Deferred Action for Childhood Arrivals .

According to The Associated Press, Trump is expected to call for an end to the program in six months, possibly giving Congress the opportunity to address the status of those under the program.

Trump has been pressured to end DACA by a group of attorneys general who say the action created by the executive order that started the program in 2012 is illegal.

On Friday, House Speaker Paul Ryan, , asked Trump to hold off on killing the program to let Congress try to come up with a fix, CNN reported.

Responding to a question about DACA, Ryan, told his hometown radio station WCLO in Janesville, Wisconsin that he didnt believe Trump should kill the program because “I believe that this is something that Congress has to fix.”

What is DACA, and what comes next?

The decision could affect as many as 800,000 Dreamers, as participants in the program are known, who have signed up for the program since its 2012 inception. Immigrant rights advocates have said 200,000 more have sought legal status through DACA, which stands for Deferred Action for Childhood Arrivals, since Trump became president.

There are approximately 154,000 individuals with DACA expiration dates between now and March 5, 2018, Homeland Security spokesman David Lapan said. Under the plan announced Tuesday, those people would have just one month, until October 5, to apply for renewal, a tight deadline that is likely to present a major logjam as the U.S. processes the applications.

Trumps decision indicates hes moving ahead with his hardline immigration campaign promises despite multiple walk-backs from him on the issue of DACA and came on the same day that Republican officials from 10 states had set as a deadline for the administration to end the program.

Those officials had said they would sue the administration over DACA if Trump hadnt ended it by Sept. 5. Led by Texas Attorney General Ken Paxton, the group said the government should stop accepting DACA renewal applications, allowing those now in effect to continue until their two-year period expires.

Trump, for his part, appeared to pressure Congress to do just that in an early-morning Tweet Tuesday.

“This is a case of heart,” he said.

Congress Get Ready To Do Your Job

On Tuesday, Trump suggested he would leave it up to Congress to take legislative action on the program. He tweeted: Congress, get ready to do your job DACA!

He also retweeted a post from an account criticizing illegal immigration. Make no mistake, we are going to put the interest of AMERICAN CITIZENS FIRST! The forgotten men & women will no longer be forgotten, the original tweet said.

Trump Administration Restores Daca But Legal Challenges Loom

The Trump administration has restored the immigration program following a legal ruling, but it might mount another challenge. And even if President-elect Joe Biden tries to shore up the program during his term, DACA faces another lawsuit in Texas.

The Trump administration said Monday that it fully restored the Obama-era Deferred Action for Childhood Arrivals program that shields hundreds of thousands of young people from deportation, complying with a federal judges order.

The Department of Homeland Security posted on its website that it is accepting new applications, petitions for two-year renewals, and requests for permission to temporarily leave the United States.

But the department said it may seek relief from the order, signaling that its concession to the court order may be short-lived if its legal efforts succeed.

The announcement is still a major victory for young people who have been unable to apply since President Donald Trump ended DACA in September 2017. His administration has long argued that DACA is unconstitutional.

After the U.S. Supreme Court ruled in June that Mr. Trump violated federal law in how he ended the program, Chad Wolf, the acting Homeland Security secretary, said the administration would study its options and, until then, wouldnt accept new applications and would grant renewals for one year instead two. DACA shields about 650,000 people from deportation and makes them eligible for work permits.

Sessions Labels Daca Decision ‘compassionate’ For Ending ‘lawlessness’

Only by the reliable enforcement of immigration law can we produce safe communities, a robust middle class, and economic fairness for all Americans.

Therefore, in the best interests of our country, and in keeping with the obligations of my office, the Department of Homeland Security will begin an orderly transition and wind-down of DACA, one that provides minimum disruption. While new applications for work permits will not be accepted, all existing work permits will be honored until their date of expiration up to two full years from today. Furthermore, applications already in the pipeline will be processed, as will renewal applications for those facing near-term expiration. This is a gradual process, not a sudden phase out. Permits will not begin to expire for another six months, and will remain active for up to 24 months. Thus, in effect, I am not going to just cut DACA off, but rather provide a window of opportunity for Congress to finally act.

Our enforcement priorities remain unchanged. We are focused on criminals, security threats, recent border-crossers, visa overstays, and repeat violators. I have advised the Department of Homeland Security that DACA recipients are not enforcement priorities unless they are criminals, are involved in criminal activity, or are members of a gang.
