What’s Trump’s key legacy?

Broadly speaking: Donald Trump, and his enablers in the Republican Party and conservative media, have put American democracy to the test in an unprecedented way. As a historian who studies the intersection of media and the presidency, it is truly striking the ways in which he has convinced millions of people that his fabricated version of events is true.

What happened on 6 January at the US Capitol is a culmination of over four years during which President Trump actively advanced misinformation.


Just as Watergate and the impeachment inquiry dominated historical interpretations of Richard Nixon’s legacy for decades, I do think that this particular post-election moment will be at the forefront of historical assessments of his presidency.

Trumps Survival After Scandals

More than a year and a half since Trump left office, 58 percent of Americans hold an unfavorable view of him, according to this latest poll. That includes 89 percent of Democrats and 63 percent of independents. But 83 percent of Republicans say they still favor Trump, along with roughly a third of all Americans.


Trumps favorability among the GOP outpaces that of a handful of other Republicans who are considered potential rivals for a White House bid in 2024:

According to GOP strategist and conservative pollster Whit Ayres, most Republicans are also open to having a new candidate who carries less baggage than they believe Trump carries as their nominee in 2024.

It all depends on who the alternatives are, Ayres said. Most alternatives arent nationally known here.

Trumps political resilience is unlike anything else in U.S. presidential history, said Jeffrey Engel, who directs the Center for Presidential History at Southern Methodist University in Dallas.

As with everything with Donald Trump, history gives us no guide, Engel said.


One comparison is tough to ignore, though todays political dynamics are nearly opposite. In 1974, after an investigation uncovered that President Richard Nixons reelection campaign had bugged the phones at the Democratic National Committee headquarters, Nixon resigned in disgrace before he could be impeached. He retreated from public life and partially rebuilt his reputation in foreign policy during the decades that followed, Engel said.

He takes himself too seriously.

And if you think the CIA dont have a spy cam set up in the Oval Office, youre probably one of those people who thinks God cant see what you do in Incognito Mode. Not unlike the Almighty Lord, the CIA are always watching- so they get to hear all the stuff Trump doesnt tweet. Apparently when he doesnt have an executive order to sign he spends most of his days reading YouTube comments about himself with Fox News on in the background. The videos dont even have to be about him, he just skims through the comments section until he finds his name .

Unredacted Version Of Mueller Report

The House Judiciary Committee has subpoenaed the unredacted Mueller report and Attorney General Barr has rebuffed this, leading to a contempt citation from the committee. A lawsuit is also contemplated.

On July 26, 2019, the Judiciary Committee asked federal judge Beryl Howell, who oversaw the Mueller grand juries, to unseal the secret testimony because the committee is “investigating whether to recommend articles of impeachment” to the full House. Howell ruled in favor of the request on October 25, 2019, finding the impeachment investigation legitimate.

On November 18, 2019, The House counsel filed a brief with Judge Howell to release the materials immediately, as redacted grand jury testimony appeared to show the President perjured himself before the Mueller probe and it was part of the impeachment inquiry.

On December 16, another brief by the HJC, said that they still needed the materials, as some redacted materials appear to be related to the Ukraine matter.Previously, an appellate court had scheduled oral arguments in the case for January 3, 2020.

The House Oversight Committee issued a subpoena to the Mazars accounting firm for Trump’s financial information from before his election to the presidency. The President and his lawyers have tried to delay or prevent this information from getting to the committee by seeking a court injunction against both the committee’s leadership and Mazars.


On April 23, 2019 U.S. district judge Amit Mehta set a May 14 date for the preliminary hearing, although several weeks later he decided the entire suit would be heard on that date. May 20, Mehta ruled that accounting firm Mazars had to provide its records of Donald Trump‘s accounts from before his presidency to the House Oversight Committee in response to their subpoena. In a 41-page opinion, he asserted that Congress has the right to investigate potential illegal behavior by a president, including actions both before and after the president assumed office. The ruling was appealed by Trump’s personal legal team and briefs for such were due by no later than July 12, 2019, when oral arguments were scheduled.

Oral arguments took place on July 12, 2019, before a three-judge panel consisting of Neomi Rao, David Tatel, and Patricia Millett. On August 8, the Justice Department filed a brief supporting the president’s position. On October 11, 2019, the appeal panel affirmed the ruling 2â1 with Neomi Rao dissenting.

Impeachment Would Be Very Nice But Unless The Democrats Win More Than A Solid Majority In Congress That Strategy Winning Is Highly Unlikely The Present House Is Unlikely To Vote To Impeach And The Present Senate Is Unlikely To Convict

Conviction of a crime, with prosecution by Robert Mueller, is still the best bet. Of course, Trump has a few ways out of that. One is getting rid of Mueller. The other is the power of pardon.

The question of whether Trump could pardon himself is contentious. Some say its possible, others say no.


However, theres one maneuver which would permit Trump to be pardoned and still remain as president. He could be pushed aside under the 25th Amendment, which would give Mike Pence all the presidential powers. Pence could pardon Trump and then Trump could be readmitted to office.

Nothing in the 25th Amendment says that a President removed under that law loses his right to office permanently. Section 3 of the amendment says: Whenever the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Vice President as Acting President. In other words, Trump can remove himself through his own declaration and restore himself to office through a later declaration. In the meantime, Pence can pardon him.

This strategy might also work if Trump decides to pardon Flynn and Manafort to undercut Muellers use of either or both as witnesses against Trump. Trump is already threatening to use the pardon power in this way.

An expert on autocracy assesses how far America has slipped away from democracy, and what it will take to get it back.

In the summer of 2020, Ruth Ben-Ghiat was putting the final touches on her history of modern autocracy. She had to do it, though, without the benefit of knowing whether one of her most important subjects would remain in power come November.


But she wasnt exactly in the dark either.

She had seen enough of Donald Trumps behavior over the preceding five years to know how neatly he lined up with other strongmen she had studied and how his autocratic tendencies would influence his behavior whether he won or lost.

I just predicted that he wouldnt leave in a quiet manner, Ben-Ghiat, a professor of history and Italian studies at New York University told me recently. Hes an authoritarian, and they cant leave office. They dont have good endings and they dont leave properly.

Nearly two years later after a riot, an impeachment, and a monomaniacal campaign to punish the Republicans who tried to hold him accountable Ben-Ghiat has ample proof of her thesis. And she professes even more concern that Trumps sway over the GOP has permanently transformed the partys political culture. Hes changed the party to an authoritarian party culture, she told me. So not only do you go after external enemies, but you go after internal enemies. Youre not allowed to have any dissent.

During the Reagan transition, Elkins attended a meeting where political appointees spoke frankly about favoring industry, he told Government Executive. He was deeply committed to the programs mission, and the message from the new administration was disturbing. My first reaction was we cant lose this, Elkins said. In the end, Burford signed off on some questionable personnel actions to get her people in, Hanley recalls, but ultimately Burford herself was fired and Reagan brought back the original EPA administrator William Ruckelshaus, whose tenure Hanley recalled as his best years at EPA.

Eliminate The Education Department

Since last year, Republican candidates have tried to capitalize on some parents objections to instruction about racism, sexual orientation and gender identity. Much of the activism has focused on local school boards, where many policy decisions affecting public schools are made. But Trump recently floated an additional leverage point at the federal level.

Across the country, we need to implement strict prohibitions on teaching inappropriate racial, sexual and political material to Americas schoolchildren in any form whatsoever, Trump said at CPAC, and if federal bureaucrats are going to push this radicalism, we should abolish the Department of Education.

The Education Department, created in 1980, has about 4,400 employees and a discretionary budget of more than $78 billion. Most of the money goes to grants for local agencies to serve disadvantaged or disabled students and to financial aid or loan subsidies for college students. Trump did not specify whether some or all of those functions would be reassigned to other agencies or eliminated.

While federal law prohibits the department from setting curriculums, its Office for Civil Rights has become a culture war target for its role in enforcing protections for women and LGBTQ students. And Republicans criticized the department last year for proposing a grant program on history and civics that referenced the New York Times Magazines 1619 Project and the anti-racism author Ibram X. Kendi.

August, despite its reputation, has never been a slow month for news. Wars start in August. Coups happen. Markets crash. Governments fall. Sometimes, the news is even good. Consider the developments of the past week or so. Gas prices are dropping, with the national average falling below four dollars a gallon for the first time in months. Inflation might be peaking, and unemployment remains vanishingly low. The Senate passed a sweeping bill to address climate change and health care, less than two weeks after the bill, the Biden Administrations top priority, experienced an unlikely resurrection. President Joe Biden, finally recovered from COVID and emerging from more than two weeks in quarantine, also signed bipartisan legislation to invest tens of billions of dollars into scientific research to aid veterans suffering from exposure to burn pits, and accepted the proposed accession of Finland and Sweden to NATO. The President also announced the killing of Ayman al-Zawahiri, perhaps the worlds most wanted terrorist, after a two-decade manhunt.

And yet the banner headline on the Drudge Report on Thursday was HELL WEEK. The accompanying picture was not of Biden but of the inescapable former President.

The investigation into Donald Trumps handling of classified national security records is forcing Republicans into a strained defense during a pre-midterm sprint in which theyd much rather be talking about Joe Biden.

After having decried the FBIs search of the ex-presidents home, many Trump defenders went silent uponthe release on Friday of the probable-cause affidavit that revealed the extent of Trumps efforts to hold onto the top-secret documents. GOP worries about the developments of the case and Trump announcing a 2024 run before November are giving way to a subtle, broader warning about putting the former president too much on the ballot this fall.

Republicans should focus on defeating Democrats, and every Democrat should have the word Biden in front of their name, said Trump ally and former Republican Speaker Newt Gingrich. The Republican focus should be to win the election in November. Trump will do a fine job defending himself. Hell be fine.

Were just a month into the Trump presidency, and already so many are wondering: How can we end it?

One poll from Public Policy Polling found that as many Americans 46 percent favor impeachment of President Trump as oppose it. Ladbrokes, the betting website, offers even odds that Trump will resign or leave office through impeachment before his term ends.

Sky Bet, another site, is taking wagers on whether Trump will be out of office by July.

There have been more than 1,000 references to Watergate in the news media in the last week, according to the Nexis archival site, with even some conservatives calling for Trumps resignation or warning that he could be pushed out. Dan Rather, the former CBS News anchor who covered Watergate, says that Trumps Russia scandal isnt now at the level of Watergate but could become at least as big.

Maybe things will settle down. But what is striking about Trump is not just the dysfunction of his administration but also the vigorously denied allegations that Trumps team may have cooperated with Vladimir Putin to steal the election. Whats also different is the broad concern that Trump is both: A) unfit for office, and B) dangerously unstable. One pro-American leader in a foreign country called me up the other day and skipped the preliminaries, starting with: What the is wrong with your country?
